Introduction
These Terms of Service (“Terms”) govern the use of the FindBetterCare platform and services by:
- Participants (individuals or authorised representatives seeking to find or change their NDIS provider); and
- NDIS Service Providers (organisations or individuals registered or unregistered that provide NDIS supports and wish to receive referrals through FindBetterCare).
By accessing or using the services provided by FindBetterCare (FBC), you agree to be bound by these Terms.

About FindBetterCare
FindBetterCare is a private consultation and marketing platform. We assist NDIS Participants in:
- Identifying their needs;
- Expressing dissatisfaction with current support arrangements; and
- Connecting with NDIS-registered or unregistered providers based on those preferences.
We assist NDIS Service Providers in:
- Receiving qualified referrals from Participants actively seeking new services;
- Promoting their services to a targeted audience;
- Gaining marketing visibility in accordance with Participant demand.

Important Disclaimer
FindBetterCare is not:
- A Registered NDIS Provider;
- A Support Coordinator;
- A Plan Manager;
- An Employer;
- A Migration Agent or Registered Training Organisation (RTO).
We do not deliver any NDIS-funded support services, conduct assessments, or make service decisions on behalf of Participants. We act solely as an intermediary and consultation/marketing service facilitating introductions between Participants and Providers.
All responsibility for service delivery, suitability, compliance, and outcomes lies with the Provider and the Participant.

Participant Terms
4.1 Eligibility
Participants must:
- Be 18 years or older or have an authorised representative submit enquiries;
- Have an active NDIS plan;
- Provide accurate and complete contact details.
4.2 Consent
By submitting a request to FindBetterCare, you:
- Authorise FindBetterCare to share your basic contact and support preferences with relevant NDIS Service Providers;
- Understand that you are under no obligation to engage any provider referred to you;
- Acknowledge that FindBetterCare does not assess the clinical suitability, compliance, or qualifications of providers beyond publicly available or self-reported information.
4.3 Privacy
We manage your information in accordance with our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and applicable NDIS standards. We will never sell your personal data.

NDIS Provider Terms
5.1 Eligibility
To receive participant referrals from FindBetterCare, you must:
- Be a registered or unregistered NDIS Provider operating lawfully in Australia;
- Be actively accepting new participants;
- Complete a Provider Registration Form with accurate business, service, and contact details.
5.2 Referral Fees
Providers agree to pay a success-based referral fee as outlined in a separate Referral Agreement. This fee becomes payable only when:
- A referred Participant signs a service agreement with the Provider; and
- Service delivery has commenced.
FindBetterCare does not charge fees to participants for referrals.
5.3 Responsibilities
Providers must:
- Comply with the NDIS Code of Conduct and Practice Standards;
- Contact participants in a timely, respectful, and non-soliciting manner;
- Keep participant information secure and confidential;
- Inform FindBetterCare when services commence or if the participant withdraws.
FindBetterCare reserves the right to suspend or terminate a Provider’s access to referrals in cases of misconduct, misrepresentation, or complaints from participants.

Intellectual Property
All branding, website content, marketing materials, forms, and resources developed by FindBetterCare remain its exclusive intellectual property. Use of these materials without written permission is prohibited.

Limitation of Liability
FindBetterCare is not liable for:
- Service quality, actions, or omissions of any Provider;
- Participant satisfaction or outcomes after referral;
- Delays, errors, or cancellations between Participants and Providers;
- Any loss or damages (direct or indirect) arising from use of this service.
You use FindBetterCare at your own discretion and risk.

Termination of Access
We reserve the right to:
- Decline, suspend, or cancel access to our platform at any time if misuse, non-compliance, or unethical behavior is detected;
- Refuse service to any provider or participant who violates these Terms or the intended spirit of the platform.

Modifications to Terms
We may update these Terms at any time. Updated versions will be posted to our website. Continued use of our services constitutes acceptance of any changes.

Governing Law
These Terms are governed by the laws of Western Australia. Any disputes will be subject to the jurisdiction of its courts.
